New professions emerge and traditional professions develop continually.
Without doubt the service sector is generating a growing share of output in both developed and developing economies. Economic activity increasingly involves processing and analysing information, making judgements and providing services. More of what is produced and consumed is intangible; information, analysis, service or advice.

YOUR DUTY TO CLIENTS – THE CONSEQUENCE OF A BREACH
Legal defensibility is a key component of many things we do these days. It is not, on examination, just a case of a compensation culture gone mad. Increased awareness, confidence and knowledge play their part. And frankly if you are a professional and cause a third party to suffer loss by way of a negligent act, error, omission, mis-statement or other act leading to a claim for civil compensation, you are likely to be held accountable for the wrongdoing. Your clients will be well versed or will seek help towards dispute resolution, and may be insured in this respect.
Even if an allegation against you is completely spurious, the cost of the defence of a claim against you can reach devastating amounts.
Even if you feel you avoid problems by appropriate contractual terms either industry recommended or on the advice of legal counsel, if the claim is made then the claim must be defended. The existence of contractual limitations of liability does not always stop the claim from being made.

something that is increasingly integrated into decisions made. We

uncertainty of an eventuality rather than the uncertainty of a loss
because taking risks is not always going to bring a negative outcome.
You need to take risks; you are going to take risks and logically the
effective management of the risks you take is something that can only
result in a pleasant surprise to the bottom line!
After you have avoided, abated, allocated and retained……..
