Errors and Omissions insurance should not be confused with Public Liability insurance which excludes liability arising from advice, design or specification for a fee. Public Liability is required in addition to Errors and Omissions insurance.
Errors and Omissions insurance has no standard form of cover. Policies can vary greatly in terms of policy wording, limit of indemnity, defence costs cover and excess, so each policy needs to be checked carefully to ensure it adequately meets the needs of the policyholder.
Cover is always on a ‘claims made’ basis, which means that the policy that responds to any claim is the one in force when a claim is made irrespective of when the claim occurred.
